KOTPUTLI-BEHROR: नाबालिग से दुष्कर्म के अभियुक्त को 20 साल जेल

पॉक्सो मामलों की विशेष अदालत क्रम संख्या 3 महानगर द्वितीय ने नाबालिग को बहला फुसलाकर ले जाकर उसके साथ कई बार दुष्कर्म करने वाले अभियुक्त नेमदीन खान को बीस साल की सजा सुनाई है। साथ ही अदालत ने अभियुक्त पर 2.24 लाख रुपए का जुर्माना भी लगाया है। पीठासीन अधिकारी नरेन्द्र सिंह ने अपने आदेश में कहा कि नाबालिग की सहमति कानून में कोई महत्व नहीं रखती है। यदि अभियुक्त ने नाबालिग की सहमति से संबंध बनाए तो भी इसे अपराध की श्रेणी में ही माना जाएगा। अभियोजन पक्ष की ओर से विशेष लोक अभियोजक ललिता संजीव महरवाल ने अपने अदालत को बताया कि घटना को लेकर पीड़िता की मां ने 7 अप्रैल 2022 को रिपोर्ट दर्ज कराई थी। रिपोर्ट में कहा गया कि उसकी 16 साल की बेटी सुबह स्कूल के बाद सहेली के साथ जाने का कहकर कई थी, लेकिन वापस नहीं लौटी। उसे आसपास और रिश्तेदारों के तलाश किया, लेकिन उनका पता नहीं चला। रिपोर्ट पर कार्रवाई करते हुए पुलिस ने अभियुक्त को गिरफ्तार कर अदालत में आरोप-पत्र पेश किया। सुनवाई के दौरान पीड़िता ने अदालत को बताया कि फरवरी-2021 को नेमदीन ने उसे एकांत में मिलने बुलाया था। इसके बाद वह अक्सर मिलने लगा। इस दौरान नेमदीन ने कई बार उससे अवैध संबंध बनाए। अप्रैल 2022 को उसके साथ बस में बैठकर जयपुर से हिम्मतनगर पहुंच गई। बस में नेमदीन ने फिर उससे संबंध बनाए। जब उन्हें पता चला कि महाराष्ट्र वाले हिम्मत नगर जाना था, लेकिन वे गुजरात के हिम्मतनगर आ गए है। इसके बाद बस से देवास चले गए। यहां शक होने पर पुलिस ने उनसे पूछताछ की और परिजनों को सूचना भेज दी। इस पर उसके परिजन व पुलिस आकर उसे ले गई।
