एसीजेएम कोर्ट ने मानी पुलिस की बड़ी लापरवाही
तत्कालीन थानाधिकारी, जांच अधिकारी समेत 4 पुलिसकर्मियों के विरुद्ध कार्रवाई के आदेश

अवैध शराब के एक मामले में अदालत ने अभियुक्तों को साक्ष्यों के अभाव में दोषमुक्त कर दिया है। यही नहीं, अदालत ने इस मामले में पुलिस की घोर लापरवाही सामने आने पर तत्कालीन थानाधिकारी और जांच अधिकारी समेत 4 पुलिसकर्मियों के विरुद्ध कार्रवाई के आदेश भी दिए हैं। इसके लिए अदालत ने जिला मजिस्ट्रेट तथा पुलिस महानिदेशक को निर्णय की एक-एक प्रति भेजकर जिम्मेदार पुलिसकर्मियों के विरुद्ध की गई कार्रवाई से अवगत कराने के लिए भी कहा गया है। मामले के तथ्यों की बात करें तो कोटपूतली थाने के तत्कालीन एएसआई राजेन्द्र कुमार ने 4 अगस्त 2013 को अभियुक्त राजू उर्फ राजकुमार निवासी खिरोड़, थाना नवलगढ़ झुंझुनू के कब्जे से भारी मात्रा में अवैध शराब बरामद किए थे। आरोपी से रॉयल स्टैज, ब्लूमून ड्राईजिन, ऑफिसर च्वाईस, पार्टी स्पेशल, ड्राईजीन डीलक्स जीन, मैग्डोल नंबर वन सहित शराब की कुल 744 बोतलें बरामद की गई थी। इस संबंध में आरोपी के पास न तो वैध लाईसेंस था और न ही परमिट। मामले के अन्य अभियुक्त नारायण लाल, निवासी सवलपुरा पुलिस थाना सदर सीकर शराब परिवहन किए जाने वाले बोलेरो पिकअप का पंजीकृत स्वामी था। इस वाहन पर दूसरे वाहन की नंबर प्लेट लगाई गई थी। मामले में मुकदमा दर्ज होने के बाद पुलिस ने आरोपी राजू उर्फ राजकुमार तथा नारायणलाल के विरुद्ध विभिन्न धाराओं में न्यायालय में आरोप पत्र पेश किया, लेकिन अब अपर मुख्य न्यायिक मजिस्ट्रेट क्रम-2 डा.अजय कुमार विश्रोई ने मामले में सुनवाई करते हुए साक्ष्यों के अभाव में अभियुक्तण को दोषमुक्त घोषित कर दिया है।

न्यायालय ने मामले को गंभीर कमियों से ग्रस्त बताते हुए इसके अनुसंधान अधिकारी अवतार सिंह तथा आरोप पत्र प्रस्तुतकर्ता लक्ष्मीनारायण द्वारा पुलिसकर्मियों की रवानगी एवं आमद से संबंधित दैनिक डायरी अथवा रोजनामचा आम की प्रमाणित प्रति आरोप पत्र में संलग्न नहीं किए जाने, कैरियर साक्षी को साक्ष्य सूची में सम्मिलित नहीं किए जाने, शराब के सैंपल को एफएसएल में जमा करवाए जाने की रसीद प्रस्तुत नहीं किए जाने पर लापरवाही पूर्वक अनुसंधान पूरा कर आरोप पत्र प्रस्तुत कर दिया गया। साथ ही गवाह सुनील कुमार, रामनारायण, रामावतार तथा अनुसंधान अधिकारी अवतार सिंह के द्वारा न्यायालय के समक्ष लेखबद्ध प्रतिपरीक्षण में लापरवाही पूर्वक कथन करते हुए मामले में जब्तशुदा शराब की मात्रा, शराब की कंपनी, शराब पर अंकित मार्का के संबंध में स्पष्ट शब्दों में अनभिज्ञता जाहिर की गई है, जबकि सभी गवाह पुलिसकर्मी हैं। इन सभी ने घोर लापरवाही एवं गैर जिम्मेदारी का परिचय देते हुए न्यायालय के समक्ष साक्ष्य प्रदत्त की गई है और इन्हीं कारणों के चलते अभियुक्त संदेह का लाभ प्राप्त करने के अधिकारी हुए हैं।
इनके खिलाफ कार्रवाई के आदेश
एसीजेएम डा.अजय कुमार विश्नोई ने मामले के जांच अधिकारी व तत्कालीन एएसआई अवतार सिंह, तत्कालीन थानाधिकारी लक्ष्मीनारायण सैनी, कांस्टेबल सुनील कुमार, कांस्टेबल रामनारायण तथा रामावतार द्वारा किए गए दूषित अनुसंधान एवं न्यायालय के समक्ष साक्ष्य लेखबद्ध किए जाने में कारित घोर लापरवाही मानी है। अदालत ने इस संबंध में सामान्य नियम 2018 के आदेश 35 के नियम 6 के अंतर्गत इस निर्णय की एक-एक प्रति जिला मजिस्ट्रेट एवं पुलिस महानिदेशक को भेजकर इन सभी पुलिसकर्मियों के विरुद्ध कार्यवाही करने तथा की गई कार्यवाही से न्यायालय को अवगत कराने के आदेश दिए हैं।
