भारत गणराज्य का संविधान 26 नवम्बर 1949 को बनकर तैयार हुआ था। संविधान सभा के प्रारूप समिति के अध्यक्ष डॉ. भीमराव आंबेडकर के 125वें जयंती वर्ष के रूप में 26 नवम्बर 2015 को पहली बार भारत सरकार द्वारा संविधान दिवस सम्पूर्ण भारत में मनाया गया तथा 26 नवम्बर 2015 से प्रत्येक वर्ष सम्पूर्ण भारत में संविधान दिवस मनाया जा रहा है। इससे पहले इसे राष्ट्रीय कानून दिवस के रूप में मनाया जाता था। संविधान सभा ने भारत के संविधान को 2 वर्ष 11 माह 18 दिन में 26 नवम्बर 1949 को पूरा कर राष्ट्र को समर्पित किया। गणतंत्र भारत में 26 जनवरी 1950 से संविधान अमल में लाया गया।
भारतीयों द्वारा कई दशकों पूर्व से ‘संविधान दिवस‘ मनाया जाता रहा है। डॉ. भीमराव अंबेडकर के इस महान योगदान के रूप में भारत सरकार द्वारा पहली बार 26 नवम्बर 2015 को ‘संविधान दिवस‘ मनाया गया तथा 26 नवम्बर 2015 से प्रति वर्ष सम्पूर्ण भारत में संविधान दिवस मनाया जाता है। 26 नवंबर का दिन संविधान के महत्व का प्रसार करने, विचारों और अवधारणाओं का प्रसार करने के लिए चुना गया था। इस दिन संविधान निर्माण समिति के वरिष्ठ सदस्य डॉ. सर हरीसिंह गौर का जन्म दिवस भी होता है।
संविधान दिवस एक परिचय
संविधान दिवस हर वर्ष 26 नवंबर को मनाया जाता है। इस दिन वर्ष 1949 में भारत की संविधान सभा ने औपचारिक रूप से भारत के संविधान को अपनाया जो 26 जनवरी, 1950 को लागू हुआ। 19 नवंबर 2015 को सामाजिक न्याय और अधिकारिता मंत्रालय ने 26 नवंबर को ‘संविधान दिवस‘ के रूप में मनाने के भारत सरकार के निर्णय को अधिसूचित किया।
संविधान का निर्माण
वर्ष 1934 में एम.एन. रॉय ने पहली बार संविधान सभा के विचार का प्रस्ताव रखा। वर्ष 1946 में कैबिनेट मिशन योजना के तहत संविधान सभा के गठन के लिये चुनाव हुए। भारत के संविधान का निर्माण संविधान सभा द्वारा किया गया। भारत की संविधान सभा ने संविधान के निर्माण से संबंधित विभिन्न कार्यों से निपटने के लिये कुल 13 समितियों का गठन किया। इनमें 8 प्रमुख समितियाँ थीं और शेष अन्य थीं। मसौदा समिति, संघ शक्ति समिति, केंद्रीय संविधान समिति, प्रांतीय संविधान समिति, मौलिक अधिकारों, अल्पसंख्यकों और जनजातीय तथा बहिष्कृत क्षेत्रों पर सलाहकार समिति, प्रक्रिया समिति नियम, राज्य समिति (राज्यों के साथ बातचीत के लिये समिति), संचालन समितियां प्रमुख थी।
भारत के संविधान के संदर्भ में प्रमुख तथ्य
दुनिया का सबसे विस्तृत संविधान है। एकात्मक विशेषताओं के साथ संघीय प्रणाली। सरकार का संसदीय स्वरूप। संविधान के निर्माण में 2 वर्ष 11 महीने और 18 दिन का समय लगा। भारतीय संविधान की मूल प्रतियाँ टाइप या मुद्रित नहीं थीं। वे हस्तलिखित हैं और अब उन्हें संसद के पुस्तकालय में हीलियम में रखा गया है। प्रेम बिहारी नारायण रायज़ादा ने भारत की संरचना की अनूठी प्रतियाँ लिखी थीं। मूल रूप से भारत का संविधान अंग्रेज़ी और हिंदी में लिखा गया था। भारतीय संविधान की मूल संरचना भारत सरकार अधिनियम 1935 पर आधारित है। भारत के संविधान में कई देशों के संविधान की विशेषताओं को अपनाया गया है। भारत का संविधान भारत को एक संप्रभु, समाजवादी, धर्मनिरपेक्ष और लोकतांत्रिक गणराज्य घोषित करता है, जो अपने नागरिकों को न्याय, समानता एवं स्वतंत्रता का आश्वासन देता है तथा बंधुत्व को बढ़ावा देने का प्रयास करता है। भारत के संविधान का प्रारूप सात सदस्यों की एक समिति द्वारा तैयार किया गया था, जिसके अध्यक्ष डॉ. बी.आर. अंबेडकर थे, जिन्हें भारतीय संविधान का जनक माना जाता है। भारत का संविधान कई अन्य संविधानों से प्रेरित था, जैसे कि अमेरिकी संविधान, यूके संविधान, आयरिश संविधान, फ्राँसीसी संविधान, कनाडाई संविधान, ऑस्ट्रेलियाई संविधान और जापानी संविधान।
